1. INTRODUCTION

By accessing or using Better-Connect ("we," "us," or "our"), you agree to these Terms of Service ("Terms"). Continued use constitutes acceptance. If you disagree, discontinue use immediately.

2. SERVICES PROVIDED

Better-Connect offers AI-driven solutions for small businesses, including:

- AI Automation: Lead response, email management, scheduling, chatbots.

- Website Development: Custom design, mobile optimization, UX/UI enhancements.

- Multi-Media Marketing: Targeted ads (social, search, video), SEO, reputation management.

- Data Analytics: Conversion tracking, behavior insights, performance reporting.

- Communication Tools: 2-way texting, automated web chat, missed call text-back.

- Operational Tools: Unified inboxes, appointment automation, lead management.

Service availability, features, and pricing may change at our discretion.

3. ELIGIBILITY

You must:

- Be 18+ years old and legally authorized to enter contracts.

- Comply with all U.S. laws, including TCPA and A2P 10DLC standards for SMS/text messaging.

4. ACCOUNT RESPONSIBILITY

- You are liable for all account activity.

- Notify us immediately of unauthorized access.

- We reserve the right to suspend accounts for suspicious activity or violations.

5. PAYMENT TERMS

- Fees are non-refundable, including partial months or unused services.

- Late payments over 15 days incur a 5% fee (or the maximum allowed by law).

- Chargebacks result in immediate termination and a $50 dispute fee.

6. USE OF SERVICES

Prohibited actions include:

- Spam, phishing, or unlawful activities.

- Reverse-engineering, scraping, or exploiting vulnerabilities.

- Sending SMS/emails without recipient consent (violations may incur $1,500+ fines).

- Using AI tools to generate harmful, deceptive, or illegal content.

7. SMS/TEXT (A2P) COMPLIANCE

- Explicit opt-in required (forms, checkboxes, or verbal agreement).

- Users may opt out via STOP or email request.

- We retain consent records for 5 years (TCPA/A2P compliance).

- Msg&Data Rates May Apply.

8. INTELLECTUAL PROPERTY

- All software, content, designs, and AI models are owned by Better-Connect or its licensors.

- No rights granted beyond service access. Unauthorized use triggers legal action.

9. THIRD-PARTY INTEGRATIONS

- GoHighLevel: We deliver services via the GoHighLevel platform. We are not responsible for its uptime, security, or policy changes.

- Other Tools: We disclaim responsibility for third-party tools (e.g., Stripe, social platforms). Use them at your own risk.

10. LIMITATION OF LIABILITY

- Excluded damages: Lost profits, data loss, business interruption.

- Total liability capped at fees paid in the last 6 months.

- No warranties of uptime, error-free operation, or results.

11. SERVICE MODIFICATIONS

We may modify, suspend, or discontinue services without notice.

12. TERMINATION

- We may terminate accounts for non-payment, fraud, or violations.

- Users may cancel via written notice. Outstanding fees remain due.

13. PRIVACY

Your use of services is governed by our Privacy Policy. By using our services, you consent to data collection.

14. DISPUTE RESOLUTION

- Governing Law: Florida (Broward County).

- Mandatory Arbitration: Claims resolved via JAMS/AAA in Pompano Beach, FL. Class actions

waived.

- Fee Recovery: Prevailing party recovers legal costs.

15. CHANGES TO TERMS

Updates are effective immediately upon posting. Continued use = acceptance.
